Terms and Conditions

These terms set out the basis on which you may visit the TraderWay website and use the TraderWay dealer website and management platform.

About TraderWay

TraderWay provides website, stock management, enquiry and dealer management tools for motor dealers. References to "TraderWay", "we", "us" or "our" mean the TraderWay service operator.

Using our website

You may use our public website for lawful business and informational purposes only. You must not misuse the website, attempt unauthorised access, introduce malicious code, scrape the website at unreasonable volume or interfere with its operation.

Dealer accounts

Dealer platform access is intended for businesses and authorised users. You are responsible for keeping account credentials secure, ensuring user permissions are appropriate and notifying us promptly if you suspect unauthorised access.

You are responsible for all content, stock details, pricing, imagery, finance information and other material added to your dealer website or account.

Subscriptions, trials and payments

Pricing, trial periods and subscription details are shown on our website, in your account or agreed with you directly. Unless stated otherwise, subscriptions renew until cancelled. You are responsible for providing accurate billing information and paying charges when due.

We may suspend or restrict access if fees are unpaid, payment fails or we reasonably believe the service is being misused.

Third-party marketplace fees and costs

TraderWay may allow you to connect your own third-party accounts, including marketplace accounts such as eBay, Autotrader and other advertising, finance, valuation, payment, data or stock distribution services. Those services are provided by third parties and may charge their own fees, listing fees, insertion fees, subscription charges, advertising costs, transaction fees, penalties, taxes or other amounts.

You are responsible for all charges, fees and costs applied by third-party services connected to or used through your TraderWay account, whether those charges arise from publishing, updating, ending, cancelling or otherwise managing a vehicle advert or feed. TraderWay is not responsible for refunding, crediting, reversing or reimbursing third-party fees unless we have expressly agreed this in writing.

Before connecting a third-party account or publishing to a marketplace, you must check the relevant third party's terms, pricing, account settings and billing rules. Ending, deleting or cancelling a listing in TraderWay or in a third-party account may not cancel or reverse any fees already charged by that third party.

Dealer content and compliance

Dealers must ensure that their website content, vehicle adverts, prices, descriptions, imagery, finance information, claims and customer communications are accurate, lawful and kept up to date.

TraderWay provides software tools, but dealers remain responsible for their own consumer law, advertising, finance, data protection and trading standards obligations.

Third-party services and integrations

TraderWay may integrate with third-party services such as hosting providers, analytics tools, payment processors, vehicle marketplaces, finance providers, valuation services or data providers. Those services may have their own terms, policies, availability and charges.

We are not responsible for third-party systems outside our control, but we will use reasonable care when selecting and operating integrations that form part of the TraderWay service.

If a third-party service changes its pricing, API, policies, availability, account status or billing rules, this may affect the connected feature. You remain responsible for managing your third-party accounts and resolving billing disputes directly with the relevant provider.

Availability and changes

We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free availability. We may update, improve, suspend or remove features where needed for security, maintenance, legal compliance or product development.

Intellectual property

TraderWay, our platform, designs, software, branding and website content are owned by us or our licensors. You may not copy, reverse engineer, resell or exploit our platform except as allowed by these terms or agreed in writing.

You retain ownership of dealer content you provide. You grant us permission to host, display, process and transmit that content as needed to provide and improve the service.

Liability

Nothing in these terms limits liability that cannot be limited by law. Subject to that, TraderWay will not be liable for indirect losses, loss of profit, loss of sales, loss of data, loss of goodwill or losses caused by inaccurate dealer content, third-party services, marketplace fees or charges, account suspensions, listing removals or circumstances outside our reasonable control.

Ending or suspending access

You may stop using TraderWay or cancel your subscription in line with the cancellation process made available to you. We may suspend or end access if you breach these terms, fail to pay, create security risk or use the service unlawfully.

Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, unless mandatory consumer or local laws require otherwise.

Changes to these terms

We may update these terms from time to time. The latest version will be posted on this page with the updated date.
